Sex offender arrested for failure to change address

On Nov. 10, 2014, officers of the Owego Police Department arrested Harvey J. Smith Jr., age 33 of Owego, N.Y. for Failure to Register/Change Address – Prior conviction as a Sex Offender as required under the New York Sex Offender Registration Act, a Class D Felony and of Sex Offender Residency Restrictions – Prohibited Conduct under the Village of Owego Local Law No. 2 of the Year 2014 Section 5.A.

According to the Owego Police Department, the arrest was following an investigation into Harvey Smith Jr., a Level 2 Sex Offender, for failing to notify law enforcement of an address change after he had moved from his last registered address in the Town of Owego to the Village of Owego with a prior conviction for Failing to Register as a Sex Offender.

Harvey Smith Jr. was also arrested under the Village of Owego Local Law No. 2, a Violation which prevents a Level 2 or Level 3 Sex Offender from establishing residency in the Village of Owego within 1,000 feet of the property line of any Child Daycare Center, Community Center, Library, Place of Worship, Park, Playground or School. Harvey Smith Jr. was arraigned in the Village of Candor Court and remanded to Tioga County Jail without bail.
