The Tioga County District Attorney’s office reported last week that on Sept. 5, 2017, the New York State Court of Appeals affirmed the order of the Appellate Division in People vs. Douglas Every, which upheld Every’s conviction of Manslaughter in the First Degree for having stabbed Milton Jump at their shared home at 281 Thorn Hollow Rd. in the Town of Tioga with a large, butcher style knife on Oct. 23, 2013, killing him.

The Court of Appeals held that the defendant failed to meet the burden of his claim that he had ineffective assistance of counsel, that his objection to certain jury instructions and exclusion of certain evidence were unpreserved for appeal, and that all his remaining assertions and claims, including prosecutorial misconduct, lacked any merit.

Douglas Every was sentenced to 17 years in state prison and five years post release supervision by Tioga County Court Judge Gerald Keene on Jan. 30, 2015.

The case had been investigated by the Tioga County Sheriff’s Office.
