Second appearance at Town of Owego Court for driver charged in fatal accident

Donald L. Ulmer of Little Meadows, Pa. appeared at Town of Owego Court on Tuesday morning, Feb. 9, 2016, with the Honorable John P. Schumacher presiding.

Donald L. Ulmer was charged on Nov. 10, 2015 with Aggravated Unlicensed Operation in the third degree following a fatal accident on Nov. 9, 2015, which occurred in the area of 3550 Pennsylvania Ave. in the Town of Owego.

According to the Tioga County Sheriff’s Office investigation dated Nov. 9, 2015, a Taylor Recycling truck and employee were struck by a southbound vehicle operated by Donald L. Ulmer, age 72 of Little Meadows, Pa.

The Taylor employee, Sean R. Tilghman, age 27 of Endicott, N.Y., was pronounced dead at the scene by Tioga County Coroner Bob Williams.

At a hearing on Dec. 15, 2015 before Honorable Patrick Hogan, Donald L. Ulmer was advised of his right to counsel for the Nov. 9, 2015 accident.

Donald L. Ulmer was also involved in a previous accident.

According to the NYS Police, Troop C – Sidney, as reported on the website, nyspews.com, the NYS Police at Owego responded to the scene of a car / motorcycle accident on Aug. 17, 2014. Donald L. Ulmer, then age 71, of Little Meadows, Pa., was traveling west in a 1997 Buick sedan and turned left (south) onto Pennsylvania Avenue in front of a 2006 Yamaha motorcycle operated by Auburn D. Lyons, age 43 of South Gibson, Pa.  According to the police, Lyons was traveling east on State Route 434 approaching the intersection of Pennsylvania Avenue. Lyons was pronounced deceased by the Tioga County Coroner Stewart Bennett.

On Feb. 9, 2016, Donald L. Ulmer appeared before Honorable John P. Schumacher. Public Defender George Awad, Jr. and third assistant District Attorney Kristen Grabowski, were in attendance.

A one-year conditional discharge with no driving was rendered to Donald L. Ulmer, as well as a $500 fine with a $93 surcharge.
