I suspect the reason the Founders don’t use the word “privacy” in the Constitution is that they considered\u00a0privacy a settled manner. After all, an English judge in 1644\u00a0had\u00a0made the point that a man’s home is his castle, and our Constitution was built, after all,\u00a0on centuries of\u00a0English achievements regarding People’s rights.\u00a0Maybe they thought they had covered that base in\u00a0the\u00a0Ninth Amendment,\u00a0which declares that rights not specifically enumerated are\u00a0indeed\u00a0retained by the People.\u00a0Of course, in 1787, the People did not include women but I suspect\u00a0everyone (except perhaps Scalia) believes woman\u00a0not only got the vote in the early twentieth century but\u00a0all the benefits of the Bill of Rights.<\/p>\n
So why, I wonder, if a man’s home is his castle,\u00a0a woman, even one\u00a0lacking\u00a0real estate,\u00a0cannot\u00a0make decisions for the very\u00a0body in which she lives?\u00a0Why, if she decides to seek an abortion, must she run a gauntlet of delaying tactics dreamed up by the\u00a0money-changers of the Right (mostly men)\u00a0in order\u00a0to manipulate\u00a0some\u00a0religious\u00a0of the Right (because money-changers look for the numbers of voters their elite group lacks).<\/p>\n
And why does it work?\u00a0Embryos and fetuses are the stages a human goes through\u00a0in order to become\u00a0a human at\u00a0birth. If the barriers did not cause delay\u00a0an abortion\u00a0would in most cases\u00a0precede consciousness\u00a0(late-term abortion is almost always an issue of the mother’s or the baby-to-be’s health; it is particularly\u00a0outrageous\u00a0to interfere in the patient-doctor relationship).<\/p>\n
Believe me, pro-Choice folks love babies as much as anti-Choice people\u00a0(therefore\u00a0I resent the blockers\u00a0usurping\u00a0“pro-Life”). Susan Sarandon protested barriers to abortion while eight months pregnant. I shook my head when Billie Jean got an abortion because of her\u00a0tennis schedule (wonder if she ever “misses” that child who would be almost forty today, I reckon).<\/p>\n
Perhaps if the word\u00a0“privacy” was shown to be the very underpinning of that\u00a0vague\u00a0concept, “freedom” people would rally to its defense. As it is, I could never vote for a politician sanctimoniously\u00a0stating s\/he is Pro-life (when s\/he is really anti-Choice). First, that poll, by refusing to accept the\u00a0established law\u00a0of Roe v Wade\u00a0could make a career of simply attacking any established\u00a0law pollsters\u00a0say are unpopular in\u00a0his or her\u00a0gerrymandered district\u00a0(the Affordable Care Act, for example). That’s not governing.\u00a0\u00a0That’s simply\u00a0posturing\u00a0to win elections.<\/p>\n
