{"id":108742,"date":"2026-01-12T06:40:02","date_gmt":"2026-01-12T11:40:02","guid":{"rendered":"http:\/\/www.owegopennysaver.com\/PS\/?p=108742"},"modified":"2026-01-15T08:30:29","modified_gmt":"2026-01-15T13:30:29","slug":"nys-bail-reform-raises-cross-border-safety-concerns","status":"publish","type":"post","link":"http:\/\/www.owegopennysaver.com\/PS\/2026\/01\/12\/nys-bail-reform-raises-cross-border-safety-concerns\/","title":{"rendered":"NY&#8217;s bail reform raises cross-border safety concerns"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">By Matt Freeze &#8212;<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">New York\u2019s bail reform has not only impacted communities across the region but has also put a dent in public safety across its southern border, local law enforcement officials say.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Bradford County District Attorney Rich Wilson said New York\u2019s relaxed approach has led to more crime in general, as it creates the impression that punishments are lax across the board.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wilson said he\u2019s noticed that the people arrested in his jurisdiction from New York often have drugs on them or flee from police.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThey put the public at risk with things like that,\u201d he said. \u201cUnfortunately, the public pays the price for that because now we\u2019re subjected to more and more crime.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In recent weeks, the Owego Police Department has issued statements regarding individuals who had been arrested for shoplifting, were released, didn\u2019t appear for court, were arrested on warrants for failure to appear, and were immediately released again.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">This process has been a carousel for the two individuals about six or seven times this year, officials said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Owego Police Chief Joe Kennedy said it\u2019s unfortunately an extremely common occurrence since New York loosened its bail guidelines in 2019.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt is very frustrating \u2014 it happens over and over and over again,\u201d Kennedy said. \u201cUnfortunately, something always happens at some point. You\u2019ll usually see this in cities, where someone will be arrested 17, 18 times and released, and then you\u2019re talking a major crime where somebody gets killed or something along those lines.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It makes it very hard to do all this work, and they\u2019re just released, he continued.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said it\u2019s certainly the case that not everybody needs to be locked up, and that some people make mistakes, but reform shouldn\u2019t be to the benefit of repeat criminals.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said these repeated interactions often end up with a belligerent and dangerous suspect with regard to officer safety.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cEventually, somebody\u2019s going to get hurt by somebody that shouldn\u2019t be out \u2014 absolutely,\u201d Kennedy said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Asked whether these changes have resulted in futile feelings among his officers, Kennedy said, \u201cThat\u2019s always something that pops up, here and there, it gets very frustrating \u2014 \u2018Why are we doing this?\u2019 I always say we do our part and bring them where they need to be brought to, and then it\u2019s up to the judge and the DA to finish.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said that while their crimes eventually catch up to them, the current system does tend to breed a \u201cno consequence\u201d attitude \u2014 \u201chopefully it just catches up to them before somebody gets hurt.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said in shoplifting cases, most of the people don\u2019t even go to court, which results in a warrant where officers have to track them down, only for them to be released again.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cWe\u2019re spending a lot of time, money and effort to get them on a warrant and then they immediately get released again at 8 o\u2019clock at night or 8 o\u2019clock in the morning,\u201d he said. \u201cThey\u2019ll go out and do it again, then not show up for court. It doesn\u2019t matter how many times they break a court order; they\u2019re being released.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said repeat offenders have to commit the same crimes multiple times before a judge can even begin to consider holding them.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt\u2019s just a huge burden on the system all the way around,\u201d he said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said his officers are very connected to the community and want to help everyone, but people who deserve to be locked up for everyone\u2019s safety should be locked up.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It\u2019s a pretty regular occurrence, he said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt\u2019s getting to the point where some police departments \u2014 I\u2019m not going to say mine \u2014 on certain warrants, a department will call and say, \u2018We\u2019ve got this guy, and he has a warrant, do you want him?\u2019 And they\u2019ll say \u2018no,\u2019 because it\u2019s a waste of their manpower when they know (they\u2019re likely to be let go).\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The reforms\u2019 impact has extended to a statewide recruiting shortage, too, he said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cA good candidate for a small (police department) to get their hands on is getting more and more difficult all the time, also because nobody wants to do this job,\u201d he said, and added that this shortage and reforms are a consistent topic of discussion.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kennedy said the reforms were done in typical New York fashion, by going way too far rather than through incremental attempts to make changes that weren\u2019t detrimental to law enforcement.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cSeems like once it\u2019s done here, it\u2019s done,\u201d he said. \u201cYou never know if there will be enough will to change.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Chemung County Sheriff Bill Schrom agreed with much of Kennedy\u2019s assessment and said law enforcement has changed a lot in recent years, following his 36 years of service.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt\u2019s probably the same story, I imagine, if you talk to any (New York) law enforcement agency,\u201d he said, and echoed that the state rushed the changes through.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe problem is when they sit down and brainstorm these new laws, they don\u2019t bring the right stakeholders to the table,\u201d Schrom said. \u201cSo, they\u2019re not getting a different perspective and input than I think they should before they make these decisions, and it\u2019s turned out to be just an absolute nightmare.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Schrom said it\u2019s resulted in a lot of frustration: \u201cWe\u2019re dealing with the same people over and over again.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The state implemented the law, and then several groups, such as the New York State Sheriff Association and the District Attorney\u2019s Association, came out against it. But after the fact, it\u2019s very difficult to undo.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIt\u2019s always after the fact \u2014 the problem is they\u2019ve already put everything in motion; repealing that is next to impossible,\u201d he said. \u201cIt\u2019s just a major undertaking, and you get stuck with what they\u2019ve passed.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Further, Schrom said that judges\u2019 hands have been tied a lot more than in the past, with a lot of their discretion being taken away until several crimes have been committed.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThey\u2019ve taken a tremendous amount of discretion away from judges, where judges could, after they\u2019ve dealt with this person one or two times, say, \u2018All right, enough is enough \u2014 I\u2019m sick of seeing you and dealing with you, you\u2019re going to jail,\u2019\u201d Schrom said. \u201cWhen they take that discretion away from the judge, the judges are equally frustrated and discouraged because they have to release them, and oftentimes we end up getting blamed for that.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Everybody\u2019s hands are tied, he continued.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Schrom said some minimal reform has been attempted, but it\u2019s still always the same people being arrested over and over.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In Bradford County, Wilson said he has seen more drug arrests and police chases with people coming from New York, likely due to the perception that criminal punishment is lax across the board these days.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wilson said it\u2019s \u201cabsolutely\u201d the case that criminals are coming into Pennsylvania from New York and causing more crime and danger to the public.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cI can think of cases where somebody was charged in New York and has a serious offense up there where I would have thought that even New York would have required bail, but the person was nonetheless out,\u201d he said. \u201cI don\u2019t like to let them go back to New York because there\u2019s too much of a chance we won\u2019t see them again. It happens quite frequently.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Asked about New York police chases that ended in Bradford County earlier this year, Wilson said it\u2019s not unheard of for police in New York to not put much effort into getting criminals back into their custody because they\u2019re likely to be let back out.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wilson recalled a case where he said he was told a man named Clifton Wagner had shot his girlfriend in New York, and for whatever reason, was released, and was later found in Athens or Sayre because he thought the victim was there and broke into a home looking for her.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThat sounds pretty harsh, but that\u2019s how it\u2019s always been expressed to me,\u201d Wilson said. \u201cHe\u2019s sitting in our jail for probably 10 months or so but is being prosecuted for criminal trespass. I\u2019m told now that they may not even be going forward with the New York charges. I don\u2019t know what the story is on that, but I have learned not to rely on other jurisdictions to do our work for us.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wilson said he doesn\u2019t mind sending people to New York to answer for their crimes, but he said the concern is always that they\u2019ll come back.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThey need to know that this is not the place for that \u2014 they need to know it\u2019s different,\u201d he said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wilson said in Pennsylvania, the two most important criteria to be released are whether they\u2019re likely to show up to court and whether there\u2019s a concern for public safety.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">With a stricter approach, Wilson said it\u2019s actually better for the defendant as well, because they\u2019re not roaming free, making more poor decisions.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIf a person has a record of fleeing and eluding, running from police, that can very easily turn out to be a dangerous or even deadly situation for the officers involved, the defendant who\u2019s involved, or maybe the innocent public as well,\u201d he said. \u201cSo, we try to prevent that by not looking to incarcerate somebody who hasn\u2019t been convicted of anything yet, but I am looking to protect the community.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Tioga County Sheriff Gary Howard and Tioga County District Attorney Kirk Martin did not respond to requests for comment.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><i>(Matt Freeze is a Senior Staff Writer, Morning Times)<\/i><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Matt Freeze &#8212;
